Toxicology Report Still Pending from McDevitt Crash

Brian McDevitt lost control of his Acura and struck a BMW with two teenagers inside it on Jan. 28.

Police investigators determined that reckless driving and excessive speed were the primary causes of the crash on Jan. 28 that , co-founder of the Anne Arundel County Breaking News and Events Facebook Page.

McDevitt was killed in a two-car crash on Fort Smallwood Road near Devere Drive after police said he , crossed into oncoming traffic and struck a BMW carrying two teenagers. Police said McDevitt was thrown from his car and pronounced dead at the scene. The occupants of the other vehicle suffered minor injuries.

Evidence at the scene suggested that alcohol was involved in addition to excessive speed, according to police.

In an email to Patch, Anne Arundel County Police Department spokesman Justin Mulcahy said investigators were still looking into the possibility of alcohol and that toxicology results were pending.

On the same day as McDevitt’s crash, in a Route 50 accident when a car carrying three people drove on the wrong side of the highway and struck another vehicle.

Four days later, Maryland State Police released toxicology reports and told NBC reporters that  behind the wheel.

Thank you PATCH, for not hiding the less pleasant FACTS regarding this crash. Speed and Reckless driving WERE factors in the crash, in my opinion that makes this not much of an ACCIDENT, but more of an eventuality. I feel bad for Brian's family, but I feel worse for the two teens that have to live the rest of their lives with the memory of this crash and the knowledge that they were there when someone else died. Please make sure to share the toxicology reports as soon as they are released, the only way Brian's death can serve the community now is for it to serve as a lesson we should all learn. In life Brian always told people to slow down on the roads and take it easy, now in death it seems he is still going to share that same lesson.

100+ MPH on that road? I heard this directly from a one of the police crash investigators.. (there are witnesses who he illegally passed on the road right before) Not an accident at all... Thank goodness no one else perished. I feel for the parents of the boy killed. I'm sure they are devastated. To bury your own child is something unthinkable. A hero? Or pillar of the commmunity? I think those raising him up as this should have just remained silent from the start. He should not be trashed or bashed either. He has passed... Let the police and press report the facts and let it go at that.

what was his bad decision? amanda?
Hog Neck February 7, 2012 at 11:58 pm

Re: Rt 50 accident: I wouldn't wish this sight even on gawkers but my husband who commutes at the break of dawn said the cars involved were beyond any recognition. It was a reminder to pause for him before u step into these 2 ton machines.

It seems to me that comments from people on the BNE's Facebook page are quick to judge people involved in other tragic events. Why should it be different here?
James February 8, 2012 at 01:59 pm
I give it one day before comments on this article are closed due to the offensive nature of discussing reckless & drunk driving.
Hog Neck February 8, 2012 at 02:23 pm
If you know the a 'fact' of the event, you should offer your facts to the police as soon as possible. I pray for his parents. They will be destroyed for the rest of their lives. To bury your own child is a unthinkable thing. I wish that on no one, no matter what. Their life will never be normal or the same again.
James February 8, 2012 at 02:27 pm
so just speeding down a 2 lane road at 1am then?
Hog Neck February 8, 2012 at 02:29 pm
If you've never lost a child, one would never know. But yes, pray for his parents so they can have the strength to carry on their lives and keep the memory of their son alive. I've never lost a child, but I know some one very close who lost a child around that same age. It destroyed the mother..

No update yet? Kinda weird.

Yes, this like any other accident that takes a death is a tragedy. But for someone who reported daily on fb about accidents just like his own, he should of known better. Whether he was drunk or not, he was driving recklessly and to tell people to be silent is only going to upset the community, especially those on AACBN website. The community has the right to know the facts behind the accident, they are given out for every other person in America, maybe some can learn from his mistakes. Amanda- I pray that you would not go on a wild goose hunt to try to locate a police officer that may or may not of spoken about the case because someone, a complete stranger on a discussion board said so. Just to ruin his life?!?!

Toxicology results can take 4,6,8,12 weeks to be released. They sometimes release alcohol results quickly in high profile cases such as the Route 50 accident. Does anybody know Anne Arundel's specific policy?
vw2003 February 13, 2012 at 02:16 pm
its seems odd to release results sooner for high profile cases with alot of media coverage. they were both tragic accidents i dont see how one can require quicker results. it seems that with all accidents like this there could be other motives for delaying the results
James February 16, 2012 at 02:03 pm
Still no word ?
John Holmes February 16, 2012 at 09:05 pm
Just curious, what's involved in getting toxiclogy results and why it should take 4 -12 weeks? I think it's some sort of a cover up involved on certain cases and there's no "high profle" about it. I can get pulled over for possibly drinking and driving and within 15 inutes they know I'm drunk and how drunk I am. Brian obviously had a lot of friends, it's sad for him and his family and what's done is done.
john patch February 29, 2012 at 02:10 pm
brian may have been a good person but he didnt do anything for the neighborhood but sit around and listen to a police scanner and make an annoying amount of fb posts
CB February 29, 2012 at 02:56 pm
"John Patch," REALLY??? if you weren't a "fan" of the facebook page you wouldn't get that "annoying amount of fb posts." YOU SIR, ARE AN IDIOT!
John Holmes March 13, 2012 at 07:46 pm
No toxicology report on this case yet
vw2003 March 14, 2012 at 04:03 pm
cover up!
Amy L March 16, 2012 at 08:27 pm
Very curious that it has not been released!
John Holmes March 17, 2012 at 11:50 am
I'm sure he just dozed off while he was doing 100 + mph. Just curious as to how this would have worked out had the occupants of the other car been seriously injured.
howard rennet March 28, 2012 at 04:34 pm
Perhaps most interesting of all, the toxicology report has been completed, but the police are insisting that the media outlets PAY $200 to gain access, now THAT sounds like a coverup to me, and why? Because a Janitor died? I really don't think the police are helping this at all.
Lisa Williams Sears March 28, 2012 at 05:54 pm
agree!!
Lisa Williams Sears March 28, 2012 at 06:00 pm
we have a right to our opinion. brian obviously had issues. i agree. how can you listen to the 911 scanner all day, and hours later be dead at your own hands??? brian knew better. we all do. fatal drunk driving crashes, are NOT accidents. they are eventualities!!!! it will catch up to you. just bc brian was the admin of some facebook page. doesnt make him above the laws. if you dont believe me. look what it got him.
John Holmes March 28, 2012 at 08:32 pm
Where did you hear of the police wanting $200.00 to gain access? Never heard of such a thing. Why aren't our elected officials (Mr. Fink) looking into this further? Cuz it doesn't benefit him? Oh, that's right he's still busy trying to figure out how to increase the traffic congestion on Mountain Rd. More business for the "Turtle"
howard rennet April 6, 2012 at 12:24 am
@John Holmes. I contacted a news paper and asked them to look into this situation since we weren't getting any response from the Patch regarding the info and you know Anne Arundel County Breaking News won't say anything about it. The paper got back to me and said that the police wanted $200 for the report, so the paper was filing a freedom of information request in order to procure the complete toxicology report. Believe me I wish I was making this up, but I am not that creative. Perhaps the Patch would like to try and get this report? Maybe if the police try to extort $200 from the Patch, the Patch could do a report on that????
tom April 17, 2012 at 03:31 am
If the toxicology report came back negagtive it would be posted on AACBN. It does not matter to me though. Sad to see someone pass for any reason. Before you judge give your self a big long look in the mirror- just saying noone is perfect
